Gregory Nicolaysen. Evil, Incompetent, Owner of the Unsecure And Insecure afda.org First, A. Howard Matz allowed Killercop's Public Defenders to "recuse their entire district" from representing him, even though he begged him to not let them quit over an "unspoken" conflict. A. Howard Matz would later go on to claim Killercop "insisted on firing them." And, without facts, also claim Killercop caused them to quit. "Naturally, judge Matz then appointed a computer illiterate counsel claiming he could do a "bank-up job!" Which lead to Greg.
ENTER FORCED COUNSEL: Greg is an attorney who goes by the lofty title of "esquire." He likes to hold himself out as an attorney with " extensive experience with computer law, computer usage and computer technology." But not in the law of due process. Greg has a law office in California. Well, it's actually a front, and not a real office, more like a PO Box. Greg even has a website called afda.org. Wanna see what is in it? We can tell ya this much, it's not filled with "computer law, computer usage and computer technology."
It is however filled with other attorneys "personal and private information" like their credit card numbers, inter alia, which Greggy left unsecured for thieves to steal after he charged these other attorneys a fee to enter.
This guy is so retarded he even leaves lots and lots personal pictures of his family there, too. Below is one, of a set of dozens, stored in an .exe file titled simply, family.exe.
UPDATE: Gregg is changing the site in 2009, to make it more secure after killercop exposed his holes. Even though Gregg was appointed by the judge in this case to represent Killercop at his trial, Killercop did not want him to represent him, but that didn't slow Greggy, or the judge, down one bit. He just "forced" himself on Killercop, and then proceeded to call Killercop "incompetent." Gee, where did he get that idea from??
He "made up a Rule 43 to trump my right to be present for their "factual" finding they all forgot to make.
He then attended a "secret hearing" held by the judge to cover up their own "incompetence. "
Then the judge let him off the hook, along with the subpoena of my star witness, Gary Winnick, and made attorney David Reed take his place. SAY WHAT? 01.17.2003
Judge A. Howard Matz: "Okay. Mr. Nicolaysen, you were contacted, I think, by the court clerk because of your membership on the CJA panel, and especially because of what I have been informed is your unusually extensive experience with computer law, computer usage and computer technology."
Killercop: "I want to object to these proceedings. I have not authorized this man to speak for me. If anybody in the courtroom thinks they have authority to speak for me I want to see their authority right now."
Judge A. Howard Matz: "Mr. Nicolaysen is your lawyer and he's proceeding under the authority of the court."
Killercop: "No, he's not my lawyer. He's your lawyer. He's not my lawyer. He's your lawyer. Acknowledge that, sir. You do not speak for me."
Judge A. Howard Matz: "He has no duty to acknowledge that and you have no authority to interfere with that."
Killercop: "I have not given you authority to speak for me. Your silence acknowledges that. I object to this whole proceeding. It's a farce."
Judge A. Howard Matz: "Your objection is noted."
Killercop: "It's a kangaroo court."
Judge A. Howard Matz:"Your objection is noted and denied. Please continue, Mr. Nicolaysen."
SAY WHAT?
Killercop: "I move at this point, to remove this man as my counsel, as he no longer speaks for me."
Judge A. Howard Matz: "Sit down and I'll deal with that motion later. "Okay. Mr. Nicolaysen, do you?""
Killercop: "Objection. He does not speak for the Killercop."
Judge A. Howard Matz: "Your motion --"
Killercop: "He does not speak for the accused."
Judge A. Howard Matz: "Be quiet!"
Killercop: “I challenge the jurisdiction of this court. This examination is unlawful; and you're holding me unlawfully. You have no honor. You have lost all sense of honor in this courtroom. Kangaroo Court!"
Killercop was thereafter "removed" from the courtroom and placed in another room outside in the hallway.
Alone.
No counsel.
Deaf, dumb and blinded.
No video feed from this remote room. Darn, even this evil guy named Mitchell was entitled to a video feed (See below) But none for Killercop!!
HERE IS HOW THE SECRET HEARING COULD HAVE BEEN AVOIDED TO NOT VIOLATE THE DUE PROCESS CLAUSE AND 6TH AMENDMENT RIGHTS.
"Mitchell was absent for Smart's testimony. As he has throughout the hearings, he entered the courtroom singing a Mormon hymn and refused to stop when the judge ordered him to. U.S. Marshals removed him from the courtroom and he watched the testimony via a video feed from a remote room.
Meanwhile Greg, the prosecutor and judge Matz all gave testimony against him. Then they got the law wrong...but doubled down to the bitter end. SAY WHAT?
Judge A. Howard Matz: "The defendant's personal presence is not necessary, given that he's currently represented by Mr. Nicolaysen."
Nicolaysen: "Thank you so much. Your honor, government counsel tracks my thinking as well. I want to assure the court. We agonized over this. We spent well over an hour on the phone Friday. Spoke again on Saturday anticipating that your honor may very well want some feedback on this very point, so we're not trying to put words into the court's mouth by asking you to make a finding that you didn't make; however --"
FACT: We don't think Greg is such a computer "expert" after they find out he left lots and lots personal pictures and their personal information on his server open to the public, much like my appeals judge, Alex Kozinski The Judge, and even the prosecutor were more then business associated, they were also close friends. It was a trifecta persecution. Three against one. Pretty bad odds. For them, Can you guess why Debra Wong Yang and Greg Nicolayson were treated like royalty by judge Matz?
