In 1990, Crandell filed a petition for writ of habeas corpus in federal district court alleging that he did not voluntarily waive his right to counsel and elect to proceed pro se at trial. The district court dismissed the petition. We reversed, holding that "Crandell could not have been forced to choose between incompetent counsel and no counsel at all" and remanded to the district court for an evidentiary hearing. Crandell, 25 F.3d at 755.
